Part 1 โ Terms & Conditions
1. Electronic Record & Binding Agreement
This document constitutes an electronic record under the Information Technology Act, 2000. By accessing the platform or booking a service, the User enters into a legally binding contract with OneDayPA.in. Use of our services constitutes irrevocable acceptance of these terms in their entirety.
2. The "Human API" Service Model
OneDayPA operates as a specialized proxy facilitation platform where assistants function as physical surrogates for the Client. We do not provide licensed professional services such as legal, medical, or financial consultancy; we merely execute administrative or manual tasks provided by the Client as a surrogate presence.
3. Client Eligibility & Competency
Pursuant to Section 11 of the Indian Contract Act, 1872, the user must be at least 18 years of age and legally competent to contract. Any service requested for a minor must be booked by a legal guardian who assumes full responsibility for the assistant's interactions and the safety of the minor involved.
4. Strict Legality & Ethical Boundaries
OneDayPA reserves the absolute right to refuse any task involving contraband, illegal substances, or items prohibited under the NDPS Act, 1985. Any attempt to utilize our services for criminal activity will result in immediate termination of the session and reporting to the relevant law enforcement authorities.
5. Letter of Authority (LOA) Requirement
For all tasks involving Banking, RTO, or Property visits, the Client is legally mandated to provide a signed LoA. Our assistants will never "impersonate" a client; they will always present themselves as authorized proxies to maintain the highest level of transparency and avoid fraud allegations.
6. Right to Refuse for Safety
The safety and dignity of our assistants are paramount. OneDayPA reserves the right to withdraw an assistant from a site immediately if the environment is found to be hostile, hazardous, or unprofessional. In such cases, the full service fee remains payable to compensate the assistant for their time.
7. Zero Markup & Pure Agent Status
In compliance with GST and income tax laws, all third-party payments (stamp duty, Gov challans, etc.) are handled as "Pure Agent" reimbursements. OneDayPA does not charge a commission on these actual costs. Clients must provide these funds in advance or reimburse them immediately against digital receipts.
8. Limitation of Liability (Section 73)
Pursuant to Section 73 of the Indian Contract Act, our liability for any claim arising out of a service failure is strictly limited to the amount of the service fee paid. We are not liable for any indirect, incidental, or "consequential" losses, such as missed business opportunities or emotional distress.
9. Indemnification Clause
The Client agrees to indemnify and hold OneDayPA harmless from any legal action resulting from the Client providing inaccurate information or fraudulent documents. This includes disputes arising from property access where the Client's authority is legally contested by family members or third parties.
10. Non-Solicitation & Anti-Poaching
Clients are strictly prohibited from hiring OneDayPA assistants directly or bypassing the platform for a period of 12 months post-service. Violation of this clause shall attract a liquidated damage fee of INR 50,000, acknowledging the cost of recruitment, vetting, and training invested by the company.
11. Waiting Charges & Time Management
Service quotes include a fixed duration of on-ground assistance. If an assistant is kept waiting beyond the included hours due to hospital delays or government queues, a "Waiting Surcharge" will be billed to the Client.
12. Cancellation & Refund Policy
A 100% refund is applicable if cancelled 24 hours prior to the slot. If cancelled within 2โ12 hours, a 50% convenience fee is deducted. No refunds are provided once the assistant has departed for the location or reached the site.
13. Force Majeure
We are not liable for failures caused by events beyond our control, including natural disasters, strikes, or sudden government holidays. Under Section 56 of the Contract Act, the contract may be suspended or frustrated during such events without penalty.
14. Document Delivery Disclaimer
OneDayPA acts as a courier but is not a "Bailee" in the strict legal sense. Our responsibility ends the moment a document is submitted to a government counter or delivered to the designated recipient.
15. Third-Party Service Supervision
When assistants supervise external technicians, we act only as your "Eyes on the Ground." Any technical damage or faulty repair by the technician is their sole liability.
16. Medical Consent Protocols
In hospital escort services, our assistants provide companionship and logistics only. They are legally barred from signing medical consent forms for surgeries or risky procedures.
17. Vehicle Management & Driving
For driving services, the Client must ensure the vehicle has valid Insurance and PUC certificates. OneDayPA is not liable for mechanical failures or traffic fines from the vehicle's pre-existing conditions.
18. Intellectual Property Rights
All content, branding, the "Human API" concept, and software code are protected under the Copyright Act, 1957. No part of our platform may be copied for competing commercial purposes without explicit written consent.
19. Severability of Clauses
If any provision of these Terms is found to be unenforceable, that specific provision shall be severed without affecting the validity of the remaining clauses.
20. Dispute Resolution & Jurisdiction
Any disputes shall first be resolved through amicable mediation. If unresolved, they shall be subject to the exclusive jurisdiction of the Courts in Mumbai, Maharashtra, governed by Indian Law.
Part 2 โ Privacy & Data Protection Policy
1. Data Fiduciary Designation
Under the DPDP Act, 2023, OneDayPA is the "Data Fiduciary." We are legally responsible for determining the purpose of processing your data and ensuring every byte of information is handled with the highest standard of technical and legal care.
2. Consent-Based Processing
We process your personal data based on your "Explicit and Informed Consent." By clicking "Book Now," you provide us with a clear mandate to use your name, address, and contact details solely for the fulfillment of your requested service.
3. Collection of Sensitive Data
Tasks like elderly care or banking require "Sensitive Personal Data" (SPD). We process SPD with additional encryption and never store such data longer than strictly necessary for the task's completion.
4. Purpose Limitation Principle
Your data is used exclusively for the purpose it was collected. We will not use your information for marketing, nor share it with third parties not involved in the direct execution of that specific task.
5. The "Right to Be Forgotten"
In compliance with Section 12 of the DPDP Act, you have the right to request the erasure of your data. Once a task is complete, you can ask us to purge your documents from our active database.
6. Data Localization & Sovereignty
All personal data of Indian residents is stored on secure cloud servers physically within India. We do not transfer your sensitive personal information across international borders without explicit legal authorization.
7. Data Minimization Protocol
We follow a strict "Need-to-Know" policy. We will never ask for your Aadhaar number or bank details unless the specific task legally requires that information.
8. Assistant Confidentiality Agreements
Every OneDayPA assistant signs a legally binding NDA before being granted access to client details. They are prohibited from taking photos of private documents without explicit client permission.
9. Encryption Standards
All data transmitted is secured using TLS 1.2/1.3 encryption. At rest, sensitive documents are stored using AES-256 bit encryption.
10. Data Retention Policy
We retain service logs for 180 days to manage potential disputes. After this period, sensitive documents are permanently deleted or anonymized.
11. Third-Party Data Processors
We partner with PCI-DSS compliant payment gateways. OneDayPA never stores your full card numbers; we only receive a secure token to confirm transaction success.
12. No Data-Trade Policy
We have a strict zero-tolerance policy for selling or trading user data. Your phone number and email are never shared with telemarketers or third-party aggregators.
13. Breach Notification Protocol
In the unlikely event of a data security incident, we will notify relevant government authorities and all affected users within 72 hours of discovering the breach.
14. Right to Correction & Update
You have the absolute right to access, correct, or update your personal information in our records at any time through your profile.
15. Minor's Privacy Protection
We do not knowingly collect data from children under 18 without verifiable parental consent. All communication for a minor's task must be handled through the parent's registered account.
16. Necessary Cookies Only
Our website uses only "Session Cookies" to keep you logged in. We do not use tracking cookies or third-party pixels for targeted advertising.
17. Access Control & Audit Logs
Access to client data by internal administrators is strictly restricted and every access is logged in an Audit Log, reviewed periodically for unauthorized access.
18. Government & Law Enforcement
We will only disclose your data to government agencies when presented with a valid legal warrant or order under the CrPC or IT Act.
19. Policy Materiality Notifications
If we make a significant change to how we handle your data, we will notify you via email. Continued use of the service constitutes your informed consent to the updated practices.
20. Grievance Redressal Officer
Pursuant to the IT (Intermediary Guidelines) Rules, we have appointed a Nodal Officer. Contact grievance@onedaypa.in for privacy concerns โ full resolution within 30 business days.
